Present: Sh. Shushant Sagar, Ld. Counsel for the appellant.
Ld. Counsel for the appellant submitted that the
appellant has settled the present matter with the respondents and
a settlement deed dated 20.01.2026 was executed in that regard.
Separate statement of the Ld. counsel for the appellant was
recorded at Bar to this effect. Ld. Counsel sought permission to
withdraw the present appeal.
Perusal of Trial Court record shows that the matter
before it has also been settled and the TCR has been consigned to
Record Room.
Considering the statement made by the Ld. Counsel
for the appellant as well as the order dated 28.01.2026 passed by
the Trial Court, permission is hereby accorded to Ld. Counsel for
the appellant to withdraw the present appeal on behalf of his
client. Accordingly, the present appeal is dismissed as
withdrawn.
TCR be sent back to the concerned court within a
fortnight from today.
This case file be consigned to Record Room after
completion of due formalities.
