Matter was listed for final arguments, however, an
application has been moved on behalf of the workman pressing his
application U/s 11(3)(b) of the Industrial Disputes Act, 1947 filed by
the workman on 26.08.2023 seeking a direction to the management to
produce his appointment letter, attendance and payment of wages
register of the management for the period 2013 to 2020 and cash book
of the management for the same period.
A perusal of record reveals that the aforesaid application
was filed by the workman on26.08.2023, however, the workman has
failed to press the same for over a period of one and a half years and it
is only after the evidence on behalf of both the parties has already
been concluded that the workman has filed the present application
seeking direction to the management for production of documents in
terms of prayer made in the application filed on 26.08.2023. No
grounds are however made out in the aforesaid application for
summoning of the record from the management at this stage, in as
much as, onus to prove his employment for a continuous period of 240
days within the year immediately preceding the date of his alleged
termination was upon the workman and he has already concluded his
evidence. The application is accordingly dismissed.
Put up for furnishing of details in terms of previous order
and for final arguments on 23.04.2025.
