Present: Sh. Vinay Rathi, Ld. AR for workman alongwith workman in
person.
Ms. Mansi Bajaj and Ms. Jyoti Mahavar, Ld. AR for
management alongwith MW Sh. Amit Malik.
Examination in chief of Sh. Amit Malik recorded as MW1.
At this stage, it is stated by AR for the workman that documents
tendered today have been filed alongwith the affidavit of evidence of MW
for the first time and no leave of the court was taken before the said
documents were filed/tendered before the court. He further submits that
copy of the same has been supplied to him today itself.
Per contra, Ld. AR for the management submits that MW1 has
been repeatedly coming to this court for this cross-examination and today
she orally requests for taking the document on record and has sought leave
of the court.
Heard. Considered. Considering the submission made by both
the ARs, the documents tendered today are taken on record, subject to cost
of Rs. 2000/- to be paid by the management to the workman on the next date
of hearing.
It is stated by AR for the workman that since the documents have
been supplied to him today only, he needs to go through the same and
adjournment be granted for cross-examination of the witness.
Cross-examination of MW is deferred.
Accordingly. final opportunity is given for cross-examination of
the MW as the MW requests that he has been repeatedly coming to the
court for his cross-examination and that his cross-examination be conducted
on the next date of hearing.
