RAKESH Vs. DELHI MUNICIPAL COMMISSIONER
31.07.2025
Present:- Ms. Kajal, proxy AR for the workman.
Sh. Manik Ahluwalia, AR for the management.
Matter is listed for proper order and the respondent has
failed to file reply to the claim even after the last opportunity.
However, more time is sought by the management to file
reply/calculation sheet.
Adjournment is strongly opposed and it is submitted that
sufficient opportunities have been granted and workman is forced to
run from pillar to post.
In view of the fact that reply has not been filed even after
sufficient opportunities including the last and final opportunity given
on the previous occasions and matter was kept for proper order for
29.04.2025 when on the said date another opportunity was given to
the management since none was present on behalf of the workman,
presumption of law is that the management has nothing to say in reply
and contentions raised and amounts quantified for the claim are
deemed to be admitted.
Hence, the MCD is directed to release the following
amount as prayed in LCA.
