Present: Sh. Naman AR of the claimant.
Sh. Deepesh Verma, AR of management via VC.
Administrative officer is absent.
Despite repeated directions, reply/calculation sheet
has not been filed by the management.
AR of the management has stated that
Administrative Officer of the management is responsible for
filing of reply/calculation sheet on behalf of the management.
However, the concerned Adminstrative Officer is absent. No
explanation or sufficient cause has been shown to explain
inordinate delay in filing of reply/calculation sheet on behalf of
the management.
In these circumstances, this Court is constrained to
issue bailable warrants of sum of Rs. 5000/- against concerned
Administrative Officer, to be executed through SHO concerned
and it is directed that concerned Adminstrative Officer shall file
file reply /calculation sheet along with sevice record of the
workman possitively on NDOH.
Additionally, let notice be issued under section 30
CPC to Commissioner, MCD (management no.1) and to the
concerned Deputy Commissioner (management no. 2) with
direction to ensure that reply/calculation sheet to aforesaid
application of workman as well as the service record of the
workman, is filed in Court by NDOH, failing which, they are
directed to be present in person before Court to furnish
explanation for non-compliance of directions of this Court.
Let copy of this order be sent to the Commissioner,
MCD (management no.1) and concerned Deputy Commissioner
(management no. 2) along with notice under section 30 CPC, for
information and compliance.
Put up for compliance of directions of the Court for
23.07.2026.
