Present: Sh. Saurabh Rastogi, AR for the workman (through video
conference).
Sh. Neeraj Kumar Bhagat, AR for the management (through
video conference).
The matter is fixed for framing of issues. Today, both the ARs
for the parties have appeared through video conference.
From the pleadings of the parties, following issues arose and
are being framed:
(1) Whether the services of the claimant were terminated
illegally and / or unjustifiably by the Management on
dated 12.10.2018? OPW
(2) Whether the claimant has started abstaining from
duty without any information since 12.10.2018? OPM.
(3) Relief.
No other issues arises or pressed upon by any of the parties.
In view of huge pendency of the cases in this Court, the matter
stands adjourned for evidence of workman on 27.01.2023. Workman is
directed to file affidavit(s) of all witness(es) in the court at least one week
prior to next date of hearing and to supply copies thereof to the
management or its AR in the similar fashion.
At this stage, this Court has tried to corroborate the chances of
settlement between the parties from the ARs of the parties and they have
apprised to the Court that there are chances of settlement between the

parties. Accordingly, to come up for talk of settlement on 23.02.2022. Both
the parties are directed to remain present on the next date of hearing.
