for the complainant department.
Matter is listed today for consideration on the
application filed under Section 208 of BNSS on behalf of
applicant/complainant department for disobeying directions
issued under Section 50 of Prevention of Money Laundering Act
2002.
Ld. SPP on behalf of the complainant department
submits that since the present proceedings emanate from the
ECIR which was registered before BNSS, 2023 came into
existence, the present proceedings shall be governed by CrPC.
Heard.
In view of the plain reading of Section 531 of
BNSS, 2023 and the law laid down by the Hon’ble High Court of
Delhi in
Prince vs. State of Government of NCT of Delhi & Anr.,
2024 SCC OnLine Del 4909 and State through RPF vs.
Dharmendra @ Dharma, Crl. L.P. 472/2024 decided on
26.09.2024, I am of the view that the provisions of BNSS shall
apply.
Notice be issued to the proposed accused under
proviso to Section 223, BNSS, 2023, through the IO for the
NDOH.
Put up on 26.03.2025 for further proceedings.
