Matter is listed today for consideration on the
application filed on behalf of the prosecution for release of original
document no. 819 for the purpose of further investigation.
It is submitted that document no. 819 is required for
obtaining opinion from the CFSL as further investigation qua the role
of accused persons is underway. Ld. PP submitted that document as
mentioned in the application be returned for the purposes of further
investigation.
Heard on the application. Record perused.
In view of the submissions made by Ld. PP, application
seeking return of original document no. 819 is allowed. Ahlmad is
directed to return the document in original (as the case may be) to the
IO/HIO against acknowledgment, as per rules. IO/HIO is also directed
to place on record the self attested copy of the document no. 819 with
the Ahlmad of this court at the time of taking original document (as
mentioned in the application) from the Ahlmad. Needless to say,
ensuring safe custody of document (as mentioned in the application)
shall be the responsibility of IO/HIO.
The instant application stands disposed of.
