Sh. Sanjiv Kumar Singh, Ld. Counsel for the complainant.(through VC) Ms. Sakshi Kumari, Ld. Proxy Counsel for the complainant. This is application filed on behalf of applicant Poonam Pandey with the prayer to continue the proceedings in complaint Case No.8566/2018 and to start recording the pre- summoning evidence. Perusal of record shows that the applicant/complainant had filed a complaint u/s 200 Cr.P.C. along with an application u/s 156(3) Cr.P.C. The said complaint was registered as CC No.8566/2018 PS:Mehrauli. Thereafter, the application u/s 156(3) Cr.P.C. was allowed vide order dated 07.07.2018 and accordingly, FIR No.85/23 PS:Mehrauli was lodged. In view of the registration of FIR, vide order dated 27.05.2023 passed by the then Ld. MM, South-District, Delhi, the complaint case was tagged with the main file of case bearing FIR No.85/23 in which cancellation report was filed. The said cancellation report, though rejected by the then Ld. ACMM vide -- 1 of 2 -- order dated 10.10.2023, has been accepted by the Ld. Revisionist Court vide order dated 16.12.2023. Thereafter, an application u/s 340 Cr.P.C. was filed by the respondent/proposed accused persons against the complainant/applicant. The said application was dismissed by the then Ld. ACMM vide order dated 06.03.2024 but was subsequently allowed by the Ld. Appellate Court vide its order dated 20.02.2025 and accordingly, a complaint u/s 340 Cr.P.C. was filed against the applicant/complainant. It is at this stage that the applicant/complainant has filed the present application seeking continuance of the complaint case and recording of her pre-summoning evidence. One opportunity is given to the counsel for the applicant/complainant for advancing arguments on the maintainability on the present application. Put up for arguments on maintainability on 17.12.2025.
