Perused the order dated 27.01.2023 passed by Ld. Principal District & Sessions Judge-cum-Special Judge (PC Act) (CBI), RADC, New Delhi wherein inter-alia, a reference has been made to the order dated 23.01.2023 passed by Ld. Special Judge (PC Act) CBI-02, RADC, New Delhi, vide which it was observed that permission to investigate the case U/s 17 A PC Act against the bank officials had been declined, no offence under PC Act had been made out and offences under IPC were the ones which were triable by the Court of Magistrate. Vide order dated 27.01.2023, Ld. Principal District & Sessions Judge-cum-Special Judge (PC Act) (CBI), RADC, New Delhi has observed that the charge-sheet has been filed for the offences under IPC only and offences are such as are triable by the Magistrate and in view of the order dated 23.01.2023 passed by the Ld. Special Judge, the charge-sheet and all other related documents have been sent to this Court with the direction that it may be tried by the undersigned or assigned to any other court of competent jurisdiction. Accordingly, the present case file is assigned to Sh. Deepak Kumar-II, Ld. ACMM-02, RADC, New Delhi for proceeding further as per law. DL00524 -- 1 of 2 -- (2) File be placed before Sh.
