Matter is listed today for consideration on the
application filed on behalf of the prosecution for issuance of
fresh proclamation under Section 82 CrPC against accused
persons namely Madhukar Dubey, Bhim Singh Chauhan, Deshraj
Raghuvanshi and Satender Kumar.
Heard on the application. Record perused.
It is stated in the application that this court, on earlier
occasions, was pleased to issue summons/warrants against the
accused persons namely Madhukar Dubey, Bhim Singh Chauhan,
Deshraj Raghuvanshi and Satender Kumar, however, despite due
service of the same, the accused persons have deliberately failed
to appear before the court; that thereafter, NBWs issued against
all the abovenamed accused persons could not be executed as
they are absconding and are deliberately concealing themselves
to evade execution of warrants; that vide order dated 10.03.2026,
this court was pleased to issue Proclamation under Section 82
CrPC against the abovenamed accused persons but the
proclamation could not be executed within the prescribed time as

the financial approval from the Competent Authority alongwith
completion of requisite departmental formalities for publication
in newspapers was received only on the last date of the
proclamation period. Hence, fresh proclamation under Section 82
CrPC be issued against the accused persons namely Madhukar
Dubey, Bhim Singh Chauhan, Deshraj Raghuvanshi and Satender
Kumar.
Considering the facts and circumstances of the
present case, the instant application stands allowed. Let fresh
process under Section 82 CrPC be issued against the accused
persons namely Madhukar Dubey, Bhim Singh Chauhan, Deshraj
Raghuvanshi and Satender Kumar and proclamation be also
published in a daily newspaper circulating in the place where the
accused persons are ordinarily resides. Report on the process be
filed on the NDOH. Process server shall also appear on the
NDOH alongwith original newspaper for recording of his
statement.
