It is submitted on behalf of proposed accused no.1, who is
petitioner no. 2 in W.P.(Crl.) 729/2023 pending before Hon’ble Bombay
High Court, as well as Ld. SPP for DoE, that the matter before Hon’ble
Bombay High Court was fixed yesterday, but it could not be taken up and is
likely to be taken up in the first week of February.
Meanwhile, DoE has filed short submissions in writing and
copy of the same is supplied to the Counsel for proposed A1.
Put up for clarification, and the proposed A1 as well as DoE
may seek clarification from the Hon’ble High Court, otherwise to come up
for hearing on this aspect of the matter, so that this issue as to the coercive
step not to be adopted against the petitioner no. 2 in the above mentioned
Writ Petition as well as the Order on cognizance can be pronounced by this
Court.
