This application is moved by applicant/surety Badal
Kumar seeking withdrawal of surety bond for accused Sohan Lal.
IO filed a report submitting therein that death
certificate of accused Sohan Lal has been verified from Department of
Medical and Health Grama Panchayat Ogipur, Gabhana, Aligarh, UP.
Statements of three witnesses have also been annexed with the report.
Ld. Counsel for the applicant/surety submits that the
death of accused Sohan Lal on 17.07.2024 has already been verified
and as such his surety i.e. applicant Badal Kumar may kindly be
permitted to withdraw his surety bond and an original FDR of Rs.
1,01,000/- of the applicant/surety, which was kept on record, be
released to him.
Ld. Chief P.P. for the State submits that since the
death of accused Sohan Lal has already been verified by IO and as
such he has no objection if this application is allowed.
In view of the fact that death of accused Sohan Lal has
been verified by the IO, his bail bond stands cancelled and surety
Badal Kumar stands discharged. Endorsement on his documents, if
any, stands cancelled.

As reported by Reader of court, bail bond of accused
Sohan Lal was accepted on 20.06.2023 in which applicant Badal
Kumar stood his surety and an original FDR no. 947037 of
Rs.1,01,000/- issued in favour of surety Badal Kumar by Punjab &
Sind Bank was kept on record.
Accordingly, Ahlmad is directed to return the above-
said original FDR to applicant/surety Badal Kumar on production of
valid ID proof against proper acknowledgment.
Application stands disposed off accordingly.
