PW- 9: Statement of Retd. SI Krishan Kumar, S/o Mr.
Gajraj Singh Sharma, R/o village Uttraoli, PS

In the year 2014, I was posted at ACB. On
24.03.2014, I was performing the duty of Duty Officer in ACB on
that day and my duty hours were in between 2.00 PM to 10.00 PM.
Insp. Vinay Malik who was also posted there handed over one
complaint to me and on the basis of the said complaint, FIR no.
25/2014, PS ACB was registered as per the directions of the senior
officers. After registration of the case, the investigation was
marked to Insp. Satender Dhull. I handed over the complaint and
the copy of FIR to him.
At this stage, the witness states that he has brought th
book containing the original FIR bearing no. 25/2014. Copy of the
same is now Ex. PW-9/1 (OSR). Copy of the FIR is also supplied
to the Ld. Defence Counsel.
At this stage, the original case file of FIR no.
25/2014 is produced by H. Suresh Kumar Singh, Dy. SP, CBI,
ACB, Delhi containing the original complaint. The original
complaint dated 24.03.2014 is shown to the witness and the
witness identifies his endorsement at Point A on the said complaint
and also his signatures at Point B. The copy of the endorsement is
now Ex. PW-9/2. During the registration of the FIR, I had also
lodged DD no. 37 dated 24.03.2014. Today, I have brought the

register containing the aforesaid DD entry. Copy of the same is
now Ex. PW-9/3. (Copy supplied to Ld. Defence Counsel).

On 13.06.2014, I was the Duty Officer at ACB and a
complaint dated 13.06.2014 was handed over to me by Insp.
Satender Dhull. On the basis of the aforesaid complaint, I
registered case FIR no. 43/2014. Carbon copy of the same kept on
the judicial file is now Ex. PW-9/4. During the registration of the
FIR, I had also lodged DD no. 29 dated 13.06.2014. I can also
produce the same on the next date of hearing.
At this stage, the complaint dated 13.06.2014 is
shown to the witness and the witness identifies his endorsement
and signature at Point A on the said complaint. The same is now
Ex. PW-9/5.
Further examination in chief is deferred for the want
of original DD register containing DD no. 29 dated 13.06.2014
and also the original book containing the aforesaid FIR.

PW- 10: Statement of Mr. Deepak Ahuja, AAO (Assistant
Administrative Officer), Office of Chief Engineer,

In the year 2014, I was posted as Office
Superintendent in the office of Executive engineer, M-352, PWD,
BSA Hospital, Sector-6, Rohini. In the year 2014, I was asked to
join the investigation by Insp. Satender Dhull. I was taken to FSL,
Rohini by Insp. Satender Dhull for identification of nine accused
persons. At the FSL, nine CDs were played before me and I was
asked to identify the accused persons and I had identified all the
nine accused persons in the CDs played before me. All the nine
accused persons were field staff of our department and I had
identified them. A document regarding identification of accused
persons was prepared by Insp. Satender Dhull.
At this stage, the copy of the identification memo
dated 11.12.2014 kept on the judicial file is shown to the witness
and the witness identifies his signature at Point A on the said
memo.
At this stage, H. Suresh Kumar Singh, Dy. SP, CBI,
ACB, Delhi produces original case file of FIR no. 25/2014. Copy
of the said identification memo dated 11.12.2014 is now Ex.
PW-10/1 (OSR). Witness states that the said chart in the
identification memo regarding the identity of the accused persons
was prepared on that day by Insp. Satender Dhull. The PIMS data

of all the accused persons including Sh. Rajender Datt Vashistha
was provided by me to the Insp. Satender Dhull. The attested copy
of the same kept on the judicial file of accused Rajender Datt
Vashistha is now Ex. PW-10/2 (Colly.) running into three pages.
My attestation is at Point A on the aforesaid document. I do not
know the name of the contractor whose voice was in the CD.
Further examination in chief is deferred for want of
CD player.
