the applicant/accused Anil Kumar Ahuja.

This is an application moved on behalf of the
applicant/accused Anil Kumar Ahuja seeking release of his mobile phone
seized during his arrest.
Reply of IO filed by SI Ajit.
Ld. counsel submits that mobile phone make Samsung
was seized from the applicant/accused at the time of his arrest and the
same is not required for investigation in this case. Ld. Counsel prays that
the mobile phone be released to the applicant/accused.
Ld. Chief.P.P. for the State submits that as per reply
filed by IO, one mobile phone was seized during personal search of
applicant/accused, which is not incriminating evidence and as such not
required in the investigation, hence, he has no objection if the same be
released to the applicant/accused.
I have perused the reply filed by IO.
In view of submission made, SHO PS ACB is directed to
release the personal search articles i.e. mobile phone make Samsung to
him on production of valid ID proof and against proper acknowledgment.
Accordingly, application stands disposed off.
Copy of order be sent to the SHO/IO concerned and be
also given dasti to the ld. Counsel for the applicant/accused.
