This is an application for de-freezing of Current
Account of M/s Baba Construction Company, and seeking release
of documents, filed by applicant/accused Arun Gupta.
Present : Sh. Ravindra Kumar, Ld. Chief PP for State.
Applicant in person alongwith Sh. Sanjay Gupta and
Sh. Raj Kamal Arya, Advocates.
SI Amitabh Rathi on behalf of IO/ACP Ashok Kumar
Singh.
Written request of IO has been received, seeking
exemption from his personal appearance on the ground that he has
been detailed for Republic Day arrangement duty. For the reasons
stated therein, the IO concerned is personally exempted for today.
Part arguments heard. During the course of arguments,
Ld. Counsel for applicant/accused seeks and is permitted to file
certain documents on record during the course of day, with
direction to supply copies thereof to the opposite side.
A bare perusal of reply dated 21.11.2025 filed by IO,
would reveal that same is quite vague in as much as it does not
state as to whether the amount lying in the relevant bank account,
constitutes “
proceeds of crime” or otherwise and what is the exact
stand of the investigating agency and the reasons for freezing the
said bank account.
In view of above, IO is directed to verify the
additional documents, if any, filed by applicant/accused and also to
file detailed and specific reply to the application in hand on the
next date of hearing.

On request of Ld. Chief PP for State, IO concerned be
also called through notice for providing assistance to him, during
hearing of this application, for next date and time. It be mentioned
in the said notice that no request for exemption from personal
appearance shall be entertained by the Court.
On request, put up on 20.01.2026 at 12:30 pm for
further arguments on the application.
