An application has been filed by Applicant /Revisionist for
passing specific directions to the Ld. Trial Court for not to
proceed in the CC No. 04/2024, listed for today and to adjourn
the matter after 19.11.2024, received through Bail and Filing
Section.
Present : Sh. Rajiv Mohan & Sh. Rehan Khan, Ld. Counsels
for Applicant/ Revisionist ( through VC).
Mr. Zoheb Hossain, Ld. Special Counsel (through
VC), Sh N.K. Matta ( through VC) & Sh. Simon Benjamin, Ld.
SPPs for ED.
On the last date of hearing, when copies of the
revision petition was supplied to the DoE, it was understanding
between the parties that they will seek adjournment before the
Ld. Trial Court. However, Today it is submitted by Sh N.K.
Matta, Ld. SPP that they have changed the instance as there have
been certain developments in the Hon’ble High Court of Delhi
with regard to the pendency of another related petition.
I do not find any mertis in the application for
issuing direction to the Ld. Trial Court as the revisionist has to
satisify the court regarding the bar contained in Section 438 (2)

of BNSS, 2023. Accordingly, the present application is disposed
off accordingly.
As prayed, copy of the order be given dasti to both
the parties.
