This is application for bail filed on behalf of applicant/accused Manoj Goyal.
Present : Sh. Manoj Kumar Garg, Ld. PP for State.
Sh. Ankit Bhatia, Ld Counsel for applicant Manoj Goyal.
Inspector Lakshmi is present on behalf of IO ACP Jarnail Singh.
Ld. Counsel for the applicant submits that he has recently been engaged. He submits
that the applicant does not want to continue to be represented by the previous counsel. He
has also placed on record an affidavit sworn in by wife of applicant. It is stated in the affidavit
as follows:
“Manu Goyal, W/o. Mr. Manoj Goyal, aged about 30 years, R/o C-79/69 T-
Huts Aram Bagh Pahar Ganj, Delhi-110055 do hereby solemnly affirm and
state as under:
1. I am the wife and the pairokar of the Applicant.
2. I was married to the Applicant on 22.01.2013 and since then have been
residing at the aforementioned address, i.e. C-79/69 T-Huts Aram Bagh Pahar
Ganj, Delhi-110055 with my husband/Applicant, my mother in law, and my
two minor sons.
3. Even otherwise, the applicant has been residing at the aforesaid address
for the past 33 years, i.e. since his birth on 17.03.1991.

4. Upon a perusal of the order sheets of the present case, it came to my
knowledge that the previous counsel engaged for the applicant had made a
submission before this Hon’ble that the Applicant has been residing at some
address at Inderpuri.
5. I was shocked upon coming to know about the aforesaid submission being
made by the previous counsel as the said statement is incorrect since the
Applicant has been residing at C-79/69, T-Huts, Aram Bagh, Pahar Ganj,
Delhi-110055 with his family for the past 31 years.
6. The previous counsel had also not sought any instructions from me or the
applicant regarding the address before making the said submission in court.
The same was also confirmed to me by the Applicant when I visited him in
jail.
7. Upon learning about the aforesaid incorrect submission made by the
previous counsel counsel, I immediately took steps to engage another
advocate and also got a fresh vakalatanama executed by the Applicant in jail
which has now been filed before this Hon’ble Court.
8. I wish to state that the correct address of the Applicant is C79/69, T-Huts,
Aram Bagh, Pahar Ganj, Delhi-110055 and the statement made by the
previous counsel with respect to the Inderpuri address is incorrect and was
made without any instructions from me or the Applicant.
9. The contents of the present Affidavit have been prepared on my
instructions and have also been explained to me in vernacular, although I
understand English also.”
The affidavit is taken on record. The explanation of the applicant regarding the
submission made about the applicant residing at Inderpuri address is accepted.
I have heard arguments advanced by Ld. Counsel for applicant and Ld. PP for the
State on the application for bail.
