for applicant/accused Hari Om.
This is an application moved on behalf of the
applicant Hari Om under section 483 BNSS read with section
21(c) of MCOC Act seeking extension of interim bail for two
months.
Presently, the applicant is in judicial custody as he
surrendered during the pendency of the present interim bail
application.
I have considered the medical ailments, as detailed
in the interim bail application, from which the applicant is
suffering from. There are medical documents annexed with the
interim bail application in support thereof.
I have also considered the report of the Chief
Medical Officer/Senior Medical Officer, Jail Dispensary which
makes is amply clear that the applicant is suffering from multiple
ailments. Some of the treatments cannot be provided at the jail
and for which, the applicant needs to be/is regularly referred to
Dr. Baba Saheb Ambedkar Hospital, Delhi.
I have also considered the report of AIIMS and a

word used therein is "
If his symptoms have approved, he needs
not further intervention/treatment", however, the medical records,
the CMO's report makes it amply clear that the applicant's
condition has not improved.
It is also to be noted that the applicant has in the past
been enlarged on interim bail and there is nothing on record to
suggest that he misused the liberty as was granted to him.
Therefore, considering the overall facts &
circumstances and on humanitarian grounds the
accused/applicant is admitted to interim bail for one month from
the date of his release on furnishing bail bonds in the sum of Rs.
50,000/- with one surety of like amount. During this period, the
applicant shall not do anything that hampers the trial or
prejudices the prosecution case. He shall not contact the
witnesses or influence in any manner whatsoever. He shall not
leave the State without the permission of this court.
It is also made clear to the applicant that if he does
not undertake the requisite treatment for all his ailments, further
application or further extension of interim bail on medical ground
shall not be entertained for the ailments he is suffering from.
The applicant shall immediately surrender on expiry
of one month since the date of his release. With these observation
the bail application stands disposed of.
