This is an application moved by applicant/accused Harneet
Singh Bindra seeking release of mobile phone make “Apple iPhone”
alongwith SIM card bearing mobile no. 9818060111 on superdari.
Present : Sh. Masood Ahmad, ld. Chief P.P. for the State.
Sh. Ayush Kumar Singh, ld. counsel for the
applicant/accused Harneet Singh Bindra.
Reply of IO/ACP Jarnail Singh filed on record.
Ld. Chief P.P. for the State submits that as per reply filed
by IO, one voilet colour mobile phone no. 9818060111 make ‘Apple
iPhone’ was recovered from the applicant/accused Harneet Singh Bindra
vide personal search memo dated 14.02.2024. However, later the said
mobile phone was seized for evidence purpose and an endorsement dated
21.02.2024 was made over said personal search memo dated 14.02.2024 and
same was deposited at Malkhana PS Civil Lines. It is further stated that
there may be incriminating evidence in the said mobile phone as messages
were found deleted and as such same was deposited in FSL Rohini for data
retrieval and FSL result is awaited. It is urged that the said phone is case
property, which is required for further investigation in this case and as such
a prayer is made for dismissal of present application.
Considering the reply filed by the IO, request for release of
mobile phone handset make ‘Apple iPhone’ alongwith SIM card bearing
mobile no. 9818060111 is hereby declined. Accordingly, present application
stands disposed of as dismissed.
