passport on behalf of applicant/accused Vinay Bansal.

Applicant/accused Vinay Bansal with counsel Ms. Babita Ahlawat.

Reply is filed by the investigating officer. The said reply is taken on
record. Copy of the said reply is supplied to the Ld. Counsel for
applicant/accused.
I have asked the investigating officer about the status of
investigation. She states that she has already sought sanction under Section 19
of the Prevention of Corruption Act, 1988 and she has not received sanction since
almost ten months.
Let notice be issued to the sanctioning authority with directions to
disclose the reasons for delay. It is made clear that this is not a direction to grant
sanction and that the request for sanction must be decided on its own merits. The
only concern of the Court is that the investigation has not culminated into a final
police report only due to the said delay which is in conflict with proviso of Section
19 (1) of the Prevention of Corruption Act, 1988.
The application of accused Vinay Bansal is deferred to be
considered on the next date, after being placed with the records of the case.
