1. The FIR of this case was registered, on 02.07.2014, on the basis of
complaint dated 17.01.2014, made by the complainant, Sh. Amit Maan.
2. In the complaint dated 17.01.2014, the complainant, Sh. Amit Maan
had interalia alleged that during the investigation of FIR No.513/2013, PS
Shahbad Dairy, the IO, HC Mahender Singh had demanded Rs.11,000/ from him
as “file charge” and upon his refusal to pay the said money, the IO, HC Mahender
Singh had not fairly investigated FIR No.513/2013, PS Shahbad Dairy.
3. Upon conclusion of investigation of this case, the IO, ACP Ranbir
Singh has disbelieved the aforesaid allegation of the complainant, Sh. Amit
Maan, on the premise that it has not been corroborated by any external source
viz. a witness or a video.
4. In G. J. Mhatre v State of Maharashtra, (2004) 7 SCC 768, it has
been held by the Hon'ble Supreme Court that before accepting a closure report or
a partial closure report, the concerned Court should hear the complainant.
5. In view of the aforesaid position of law, it is directed that notice shall
be issued to the complainant, Sh. Amit Maan, returnable on the next date so that

he can be heard qua the nonprosecution of HC Mahender Singh by the State/the
IO, ACP Ranbir Singh.
