With regard to I/Card and wallet containing Rs. 500/- and
other articles belonging to applicant/A-2, CBI has no objection if
it may be returned to the applicant/accused as they belongs to A-
2 personally and are not part of material evidence against
accused persons. With regard to mobile phone of A-2 in
question, it is stated that it is the case property and material piece
of evidence which would be required during recording of
evidence and it should not be returned.
In my considered opinion, therefore, mobile phone in
question cannot be allowed to be returned to A-2 at this stage.
Regarding other article, i.e. I/card, wallet containing Rs. 500/-
and other articles of personal search of A-2, CBI has no
objection, therefore, in the totality of the circumstances and in

the light of above reasons, application is allowed only to the
extent that I/card and wallet of A-2 containing Rs. 500/- and
other articles seized in personal search be returned to A-2
accordingly. Mobile Phone shall continue to be part of
documents and shall be kept on record as it is material piece of
evidence. Application is disposed of accordingly. Copy of the
order be given dasti to both the parties.

charge on 29.07.2024.
