The present case FIR No. 23/2013 was registered u/s
7/13 POC Act. As per the charge-sheet accused Sharanappa
H.Hunagundi was not an employee of the Delhi Kannada Senior
Secondary School, Lodhi Estate, Delhi, which is a Government Aided
School but the employee of the Delhi Kannada Education Society,
Lodhi Estate, New Delhi, to which no money/Grant in Aid was
released by Department of Education or its employees on its payroll
and therefore he was not an employee of the Department of Education
and hence, sanction to prosecute him was not granted.
Charge-sheet has been filed only u/s 384 IPC and not
under the provisions of P.C. Act.
In view thereof, let present file be put up before Ld.
Principal District & Sessions Judge-cum-Special Judge-cum-Special
Judge, PC Act, CBI, RADC New Delhi for appropriate order on
20.12.2023.
