Ld. Counsel for the applicant/accused has submitted
that PAN card, Aadhaar card, ATM Card of Union Bank,
Departmental ID Card, wallet/purse containing cash of Rs. 12,950/-
and one Vivo-30 mobile phone were seized from the
applicant/accused while he was in custody of police. Ld. Counsel
prays that the same be released to the applicant/accused.
Ld. Chief P.P. for the State submitted that as per
reply filed by IO, he has no objection if the personal search articles
of the applicant/accused i.e. his PAN card, Aadhaar card, Debit
Card of Union Bank, ID Card of Delhi Jal Board, driving licence
and wallet/purse containing cash of Rs. 12,950/- be released to him.
It is urged that mobile phone of the applicant/accused is not a part
of personal search memo and same was seized through separate
seizure memo as case property, which is required to be sent to FSL
for examination and as such same may not be released to the
applicant/accused.
I have perused the reply and personal search memo
of applicant/accused filed by IO.

In view of submission made, SHO PS ACB is
directed to release the personal search articles of the
applicant/accused i.e. his PAN card, Aadhaar card, Debit Card of
Union Bank, ID Card of Delhi Jal Board, driving licence and
wallet/purse containing cash of Rs. 12,950/- to him on production
of valid ID card by the applicant/accused and against proper
acknowledgment. However, request for release of his Vivo-30
mobile phone is hereby disallowed. Accordingly, application
stands disposed off.
Copy of order be sent to the IO concerned and be
also given dasti to the ld. Counsel for the applicant/accused.
