IO Inspector Pawan Kumar is present.
1. The charge-sheet filed by IO alleging commission of offences punishable
under (a) Section 13(1)(d) read with Section 13(2) of the Prevention of
Corruption Act, 1988 and (b) Sections 120B, 420, 468 and 471 of Indian
Penal Code, 1860, by accused persons Sunder Paul Auluck, Lakhi Ram
and Rajender Singh is perused.
2. In the charge-sheet, It has been stated by IO Inspector Pawan Kumar that
proceedings against accused Late Lakhi Ram stand abated because he
died on 01.01.2006.
3. Ld. Public Prosecutor submits that accused Sunder Paul Auluck and
Rajender Singh are liable to be prosecuted qua the offences punishable
under Sections 13(1)(d) read with Section 13(2) of PC Act, 1988 read with
Sections 120B, 420, 468 and 471 of IPC.
4. Also, alongwith the aforesaid charge-sheet, Ld. Public Prosecutor has
inter-alia filed sanction order dated 12.01.2024, issued by Sh. Subhasish

Panda, Vice-Chairman, Delhi Development Authority under Section 19 of
PC Act, 1988, in respect of accused Sunder Paul Auluck.
5. In my view, the aforesaid material including the documents filed with the
charge-sheet and statements of witnesses constitutes sufficient material
for this Court to take cognizance of the above-noted offences and to
proceed against accused persons Sunder Paul Auluck and Rajender
Singh. Accordingly, in exercise of the power available under Section 190(b)
of CrPC, 1973, cognizance of above-noted offences is taken and it is
directed that summons shall be issued against accused Sunder Paul
Auluck and Rajender Singh returnable on 05.11.2024.
