Present: Mr. Vikash Kumar, Ld. Public Prosecutor for State.
IO Insp. Pawan Kumar is present.
Heard Ld. PP for the State and the IO and perused
the record.
Perusal of the chargesheet shows that the FIR was
registered under Section 13 (1) (d) POC Act r/w Sections

the chargesheet has been filed under Sections 420/468/471/120B
IPC. It is also mentioned in the chargesheet that no evidence
was found against government officials namely Vinod Kumar
Bansal, JE (C), Gajender Pal Singh, AE (C), MI Meena, Ex. En
(C), Bijay Veer Singh, JE (E&M), Anurag Mittal, AE (E&M) &
H Bhatia, EE (E&M) DJB to prosecute them under Section 13
(1) (d) of POC Act r/w Section 420/468/471/120B IPC.
Since the chargesheet has not been filed against any
government official under POC Act but only against private
individuals under various sections of Indian Penal Code, this
court is of the view that the same is triable by the court of Ld.
JMFC and not by this court.
