Fresh application on behalf of true owners of
the properties/LRs of the deceased accused Mahender
Kumar Gupta for releasing the properties/assets attached
during investigation is received by way of assignment. It
be checked and registered.
Present : Sh. Jai Batra, Ld. Counsel for applicants.
Ld. Counsel for applicants submits that Sh.
Mahender Kumar Gupta was an accused in case FIR no.26/1999,
who expired on 02.09.2013 and thereafter the proceedings
against him have been abated. It is stated that during
investigation of FIR no.28/1999, the properties and assets of Late
Mahender Kumar Gupta were seized and are liable to be released
in favour of LRs of deceased Mahender Kumar Gupta.
Ld. Counsel for applicants seeks some time to file
an affidavit of applicant no.1 that Sh. Mahender Kumar Gupta
(since deceased) is survived by the only those LRs, whose names
are mentioned at serial no. 1 to 5 in the memo of parties.
Let the original file be called from Record Room,
Tis Hazari Courts.
