State Vs Anil Kumar Ahuja
01.08.2025
This application is moved by the applicant/ accused Anil
Kumar Ahuja s/o Late Sh. Bhimsen Ahuja, seeking issuance of
appropriate directions to concerned Passport Authorities for renewal
of passport.
Present : Sh. Sukhbeer Singh, ld. Chief P.P. for the State.
Sh. Rehan Khan, Ld. counsel for the
applicant/accused.
IO/Insp. Krishan Kumar.
Reply filed by IO. Copy supplied to ld. Counsel for
applicant/accused.
Ld. Counsel for the applicant/accused submitted that
vide order dated 14.08.2024 applicant/accused was granted bail in this
case with one of the condition that he will not leave India without
prior permission of the court. It is submitted that applicant/accused is
holding a passport which will get expire on 26.01.2026. It is urged
that for renewal of passport of any accused, against whom criminal
proceedings are pending, the accused is required to produce orders of
the concerned Criminal Court allowing the renewal of the passports
for a specific period, otherwise the passport will be renewed for a
default period of one year only. It is thus prayed that the order
allowing renewal of passport specifically for a period of 10 years of
validity of passport may be passed, as the default period of 1 year is
too short period for moving an application of VISA for any travel
abroad.

Ld. Chief P.P. for the State submitted that investigation
in present case is in progress and serious nature of allegations have
been levelled against the applicant/accused. It is urged that there is
strong apprehension that the applicant/accused may flee from the
country after getting the passport, which can impede the investigation
as well as trial of the case. It is thus prayed that the application of the
applicant/accused for renewal of the passport for a period of ten years
ought not to be granted.
I have heard both parties and perused the reply of IO.
In view of the submissions, application is allowed to the
extent that the court has no objection for renewal of passport of the
applicant/accused, as per rules. However, request for renewal of
passport for a period of ten years is declined. Applicant/accused is
also directed to obtain prior permission from the court before leaving
the country.
Application accordingly stands disposed off. Copy of order be
given
Dasti to Ld. Counsel for the applicant/accused.
