Sultanpuri, Delhi, against his real brother Jai Bhagwan, his associates Sanjeev Chopra and others. He had expalined that during the month of April 2001, Jai Bhagwan S/o Chhotu Ram R/o 303, Pocket 9, Sector 21, Rohini, Delhi approached his wife for admission of his daughter in some nearby school. After due formalities, the said girl was admitted in Meri International School, Rohini. On the pretext of thanking their family but with ulterior motive, the said Jai Bhagwan developed intimacy with their family. Their family was invited at his house warming ceremony on CC No. 10/23 in FIR No. 45/2003 State vs. Closure Report Page 9 of 35 -- 9 of 35 -- 6.5.2001. On that day, they were introduced by Jai Bhagwan to one of his accomplices, Sanjeev Chopra S/o Jagannath Chopra R/o 2187/11, Guru Arjun Nagar, Patel Nagar, Delhi as the owner of three star Hotel named Prince Hotel in Nepal. Sanjeev Chopra and Jai Bhagwan tried to persuade his wife to make investment in his hotel business and in return they promised to give her share in the hotel. She refused the offer as they did not have any money to invest. Sanjeev Chopra in turn offered his wife to transfer the title (power of attorney) of their residence at P-2/381-382, Sultanpuri, Delhi and RZ-T-15, Sagarpur, Delhi with the condition to retain the physical possession thereof till they do not really intend to make investment in his so called hotel business in Nepal. 9. On 15.05.2001, his wife and he executed the power of attorney of the said property in favour of Sanjeev Chopra and it was decided that he alongwith said Sanjeev Chopra and his brother Prince Chopra would go to Nepal and see the said Prince Hotel themselves. On 18.05.2001, they went to Nepal in his Santro Car and on reaching Kathmandu in late hours of 20.5.2001, they stayed at Kamal Hotel, Kathmandu, instead of Hotel Prince. On his insistence to stay at Prince Hotel, he was told that it was too late to go to that hotel and they would proceed there next morning. 10. In the morning of 21.5.2001, before he could get up, Sanjeev Chopra drove away his car and disappeared till the night of 26.5.2001. He told him that his mother was sick and he was unable to show him the hotel presently. Then they left for Delhi. They left Kamal Hotel, Kathmandu on 27.5.2001 for Delhi, and stayed at Hotel Gangotri, Narain Ghat, Nepal, which they left in the morning of 28.5.2001. Within half an hour of driving, they reached Hotel Himalaya, Bhairva situated near Indo-Nepal border where Sanjeev Chopra told him that he has a friend living nearby and he was going to CC No. 10/23 in FIR No. 45/2003 State vs. Closure Report Page 10 of 35 -- 10 of 35 -- see him and promised to come back in half an hour. Sanjeev did not turn up the whole day and returned in the evening of the next day only. 11. In the morning of 30.5.2001, he was told that they would now proceed for Delhi but instead of proceeding for Delhi, he was again lodged in a nearby hotel called Hotel Moonlight on the pretext that they would leave only in the evening. During the daytime, one foreigner who could speak fluent English, Hindi and Nepali had some conversation with Sanjeev Chopra which he could not understand and in the meantime, Prince Chopra, younger brother of Sanjeev Chopra, left the hotel. 12. At around 5 P.M. Sanjeev, on the pretext of seeing-off the said foreigner, also left the hotel and never returned back. In between, some officers from Nepal Police came to the room and told him that they wanted to search the room. They searched the bed of Prince Chopra first, but nothing objectionable was found. Next they searched his belongings, nothing discriminatory was found in his possession as well. While searching the belongings of Sanjeev Chopra, a black polythene bag was found which contained some powder like substance. He was taken to Police Station, Bhairva and he was told that they would release him only after Lab report of the said powder like substance is received and Sanjeev and Prince are found. 13. Meanwhile, Sanjeev Chopra reached Delhi and informed his wife that Lala Ram was involved in a Police case in Nepal and he had been detained at Saloni near Indo-Nepal border. He asked his wife to pay Rs.45 Lacs for arranging his release, otherwise he would be shot by Nepal police. As his wife did not have the money, they took possession of their residence at P-2/381-382, Sultanpuri on 8/6/2001 and fraudulently got power of Attorney of RZ-T-14, Dayal Park, West Sagarpur, Delhi and never returned. After that the samples CC No. 10/23 in FIR No. 45/2003 State vs. Closure Report Page 11 of 35 -- 11 of 35 -- were got tested by Nepal police after a gap of nearby 2-1/2 months and it was found that it contained nothing objectionable but chalk mitti only. 14. As Sanjeev Chopra did not return back, his wife alongwith some of relatives reached Indo Nepal border on around 22.08.2001 and co- incidentally, after being satisfied of his non-involvement in any crime, the Nepal police released him on that day itself. 15. After their return to Delhi, he lodged an FIR against Jai Bhagwan, Sanjeev Chopra, Prince Chopra, Rajiv Chopra and Vinod Sharma. Presently, Jai Bhagwan and Rajeev Chopra are in Judicial Custody (JC) since 10.10.2001 and 17.02.2002 respectively and all others are Proclaimed offenders (PO). It is also stated that the said gang has committed various criminal offences of same type in the past as well and their actions and deeds were published in various newspapers on 17.02.2002 and various magazines also. 16. Accused Lala Ram Verma also stated that the complaint filed against him by Roshan Lal is completely false and baseless. He and his family have no assets or income earned from unknown sources or corrupt means. The complaint has been filed with the single motive of creating obstacles in the path of legal proceedings initiated by him against his brother and associates. 17. Therefore, no case of DA against alleged Lala Ram Verma was said to be made out and Supplementary Closure Report was filed. Analysis: 45. I have meticulously perused the final report (closure report) as well as the supplementary closure report and the key documents annexed thereto. The allegations against the accused were that he has amassed huge wealth by illegal means and own disproportionate assets. CC No. 10/23 in FIR No. 45/2003 State vs. Closure Report Page 33 of 35 -- 33 of 35 -- 46. The closure report provides a complete account of the income of Sh. Lala Ram Verma, his wife, Smt. Kanti Verma as well as his children Reeta Verma and Hemant Verma from the known sources as well as the expenditure of his family and assets. As per the computation provided by the IO as well as the documents, it is clear that the combined income of Sh. Lala Ram Verma, his wife, Smt. Kanti Verma and his children Reeta Verma and Hemant Verma is Rs. as well as the was Rs.26,78,073/- and their toal loan amount was Rs.7,77,000/-. Further, they received Rs.19,00,000/- from the sale of their properties. Thus, the total income of Lala Ram Verma and his family was Rs.53,55,073/-. 47. Further, the total expenses of Lala Ram Verma and his family inlcuding water bills, electricity bills and kitchen expenses is Rs. 26,22,118/- and the total value of his assets and that of his family as well as cash is Rs.15,15,396/-. Thus, the total of assets and expenses is Rs.41,37,514/- which shows that the combined income of Sh. Lala Ram Verma, his wife and children is Rs. 12,17,559/- (Rs. 53,55,073 - Rs. 41,37,514/-) in excess of the total of the assets owned by them and expense incurred by them. From the investigation, it appears that there is no reason to believe that Sh. Lala Ram Verma owned assets worth more than his income from the known sources. 48. Most importantly, the complainant did not appear before this court in the present proceedings. Summons sent to him were also received back with the report that he could not be traced. The IO also stated that the complainant could not be traced. His separate statement was recorded in this regard. Therefore, considering the evidence collected by the IOs as well as taking into account that the Complainant did not appear, this court is of the view that sufficient material is not available against accused Lala Ram Verma to prosecute him under section 13(1) (e) PC Act. CC No. 10/23 in FIR No. 45/2003 State vs. Closure Report Page 34 of 35 -- 34 of 35 -- Decision: 49. In view of the above, the Closure Report is hereby accepted.
