Accused Jagdish Chander (A-1) is already declared
absconder, vide order dated 27.03.2018.
IO/ACP D.P. Singh, DSF Unit, New Delhi District is also
present.
Heard. File perused.
An application bearing I.A. No. 3/2026, seeking issuance
of open NBWs against accused Jagdish Chander, is pending disposal.
Heard on the aforesaid application.
During the course of submissions, IO/ACP D.P. Singh
submits that in view of relevant guidelines for Indian Law Enforcement
Agencies for extradition of fugitives from abroad issued by Ministry of
External Affairs, Govt. of India and after due consultation from Ld. Chief
PP for the State, he wishes to withdraw the application. He therefore,
seeks permission to withdraw the said application, however, with liberty
to file such application afresh in future, if so required.
Separate statement of IO/ACP D.P. Singh has been
recorded in this regard.
Considering the overall facts and circumstances of the case
and in view of statement made by IO, the application is dismissed as
withdrawn, with liberty as prayed for.
Put up on 03.07.2026 for consideration on the point of
cognizance.
On request of Ld. Chief PP for State, IO/ACP D.P. Singh is
bound down for next date of hearing, for his assistance.
