Accused Jagdish Chander (A-1) is already declared
absconder, vide order dated 27.03.2018.
Sh. Dushyant Pratap Singh, Ld. Counsel for accused
Jagdish Chander (absconder).
Heard. File perused.
Record shows that an application for
cancellation/stay of proceedings u/s 82 Cr.P.C., moved by
applicant/accused Jagdish Chander is pending consideration.
Record would further show that after the last date of
hearing, the aforesaid applicant/accused has moved another
application dated 28.02.2026 seeking leave to file additional
document i.e. Departmental Inquiry Report, on record in support
of the averments made in the previous application.
Issue notice of the said application dated 28.02.2026
to State.
Ld. Chief PP has accepted notice of the said
application on behalf of State. He states at Bar that he does not
wish to file any written reply to the said application.
With joint consent of both the sides, arguments on
the said application heard.
Having heard the submissions made on behalf of
both the sides and in view of the reasons stated in the application

dated 28.02.2026, same is allowed and stands disposed off.
Consequently, copy of Departmental Inquiry Report as filed
alongwith said application, is taken on record.
Ld. Counsel for the applicant/accused has pointed
out that he has already filed deficient Court fees on record, which
submission is duly substantiated from the record.
Issue notice of the application seeking
cancellation/stay of proceedings u/s 82 Cr.P.C., moved by
applicant/accused to concerned IO/State, with direction to verify
the relevant documents annexed therewith and to submit the
written reply, if any, thereto on next date.
Put up on 30.03.2026 for consideration of aforesaid
application, and for passing appropriate directions in terms of
order dated 28.02.2026.
