Ms. Harshita Goel, Ld Counsel on behalf of NAFED is present.
1. Ms. Harshita Goel, Ld Counsel appearing on behalf of NAFED submits that
she needs copy of the charge-sheet and prays for adjournment to provide
information as per previous order.
2. Copy of charge-sheet be provided to Ld. Counsel appearing for NAFED, as
prayed.
3. Perusal of the record shows that this Court had earlier received a letter
dated 27.09.2024 issued by the inquiring authority requesting that certain
documents be provided to presenting officer Sh. Kumar Abhishek. However,
Sh. Kumar Abhishek has not yet appeared in the Court in order to collect
the said documents. Let notice be issued to Sh. Kumar Abhishek to appear
and to collect the said documents.
4. Also, on record is an endorsement of inspection of documents but it is
mentioned therein that some documents could not be inspected as they

were untraceable. However, the Ahlmad of the Court has not reported any
loss of documents. Let a report be submitted by the Ahlmad as to whether
any document is untraceable.
5. Meanwhile, let notice be issued to Sh. Sanjay Gihar and to Sh. Kumar
Abhishek with direction to disclose which document is needed to be
inspected.
6. Notice be also issued to the Investigating Officer to disclose whether there
is any document missing from the Court file and to submit the list of
documents which, according to him, had been filed.
7. It is made clear that in case the documents sought to be inspected are
available in the file of the investigating officer or in the Anti-Corruption
Branch, the Anti-Corruption Branch may be called upon to produce the said
documents.
8. Copy of this order be also sent to Sh. M. Balachandaran, inquiring authority
for information.
9. Renotify on 26.04.2025.
