IO Inspector Lakshmi Singh is present.
1. The charge-sheet filed by IO alleging commission of offences punishable
under Sections 7 and 13 of the Prevention of Corruption Act, 1988 by accused
Sher Singh Paharia is perused.
2. Ld. Public Prosecutor submits that accused Sher Singh Paharia is liable to be
prosecuted qua the offences punishable under Sections 7 and 13 of the
Prevention of Corruption Act, 1988.
3. With the charge-sheet, the investigating officer has inter-alia filed sanction
order dated 16.02.2024 issued by Sh. Naresh Kumar, Chief Secretary, Delhi
under Section 19 of the Prevention of Corruption Act, 1988, in respect of
accused Sher Singh Paharia.

4. The IO has also filed statement of witnesses, copy of FIR, complaint dated
04.03.2014, order of transfer, identification memo, seizure memo, FSL reports
and the footage in question alongwith a certificate under Section 65B of the
Indian Evidence Act. The transcript of the footage is also on record.
5. In my view, the aforesaid material constitute sufficient material for this Court to
take cognizance of the above-noted offences and to proceed against accused
Sher Singh Paharia.
6. Accordingly, in exercise of the power available under Section 190(b) of Code of
Criminal Procedure, 1973, cognizance of above-noted offences is taken and it
is directed that summons shall be issued against accused Sher Singh Paharia
returnable on 03.02.2025.
