Vigilance 31.07.2026 Present: Mr. Vikash Kumar, Ld. Public Prosecutor for State. IO Insp. Nipun Kumar in person. Heard arguments on the point of cognizance. Perused the chargesheet filed by the IO alleging commission of offence punishable under Section 7/13 (1) (d) of Prevention of Corruption Act, 1988 by accused Om Prakash Bairwa (DHG). Ld. PP for the State submits that the accused Om Prakash Bairwa is liable to be prosecuted u/s 7/13 (1) (d) Prevention of Corruption Act as there is sufficient material against him as he misused his official position and demanded and accepted Rs.100/- as bribe from the complainant Sh. Gaurav Singhal (since deceased) who recorded the incident in his mobile phone and filed the complaint against the accused on the whatsapp helpline of Vigilance. He further submits that the statement of the complainant under Section 164 Cr.PC was also recorded; the CD/DVD containing video cip uploaded by complainant was deposited in FSL, Rohini on 06.02.2026 for analysis and the report is still awaited. Further, sanction order under Section 19 of PC Act, 1988 i.e. order dated 08.11.2024 issued by Mr. D.S. Rawat, Commandant (Home Guards)/Head of Office, Directorate General of Home Guards, Nishkam Sewa Bhawan, Raja Garden, New Delhi-110002 with respect to accused Om Prakash Bairwa Contd...2/- -- 1 of 2 -- -2- (DHG) has been filed along with the chargesheet. Perusal of the chargesheet shows that the complaint is clear and categorical regarding demand and acceptance of illegal gratification by accused Om Prakash Bairwa (DHG) by misusing his official position. Further, transcript prepared from the whatsapp helpline of Vigilance Office also shows the demand and acceptance of illegal gratification. Accordingly, I hereby take cognizance of the offence under section 7/13 (1) (d) of the Prevention of Corruption Act, 1988. Issue summons upon the accused person namely Om Prakash Bairwa for the next date of hearing. List for further proceedings on 05.09.2026.
