Accused on bail with Counsel Sh. Salil Kumar Jha.
IO is not present. He has sent a request today on personal grounds. The
same is allowed. However, the IO has sent a reply, a copy of which has been supplied
to the Counsel for accused already.
Certain documents viz., siteplan, Customer Application Form of mobile
phone and statements of those witnesses which were recorded by the investigating
agency, and which were claimed to be deficient, are supplied to the accused today,
except those statements U/s 161 Cr.P.C which were not recorded qua some formal
witnesses.
The only issue which remains is supply of copy of questioned audio
recording and the voice samples. It seems that the investigating agency did not get the
copy of questioned audio recording and the copy of voice samples to be supplied to the
accused. IO is directed to take steps to send the questioned audio recording to the FSL
along with voice samples recorded in the present matter to the FSL and the FSL
authorities be requested to prepare atleast three copies of the questioned audio
recording as well as the voice samples i.e. one for the accused, one for prosecution and
one additional copy for the Court to be retained on judicial record. Let the steps be
taken.
Put up this matter on 25.04.2022.
The application U/s 207 Cr.P.C is accordingly disposed of.
