This is an application moved by applicant/ accused
Sahid Chaudhary seeking release of jamatalashi articles.

accused Sahid Chaudhary.
IO/ACP Jarnail Singh has sent a reply.
Arguments heard from both parties.
Ld. Counsel for the applicant/accused submits that
one ‘Samsung M01” mobile phone no. 9319391841, another mobile
phone no. 9319085657 make “MI”, CPU-2, Aadhar card and one
purse were seized by the police. It is urged that the said articles are
not case property in this case and as such a prayer is made to
release the said articles to the applicant/accused.
Ld. Addl. P.P. for the State submitted that as per
reply filed by IO, he has no objection if the personal search articles
i.e. one green colour mobile phone make “Redmi” IMEI No.
869580055296504 & 869580055296512, one brown colour wallet,
copy of Aadhar Card, copy of PAN Card bearing no. ENUPS7261G
and cash of Rs. 100/- be released to the applicant/accused. It is
urged that other items mentioned by the applicant/accused i.e. one
mobile phone make ‘Samsung Galaxy M01”, IMEI-1-
356148112246514, IMEI-2-356149112246512 and one CPU make
“Dell” were seized vide seizure memos and are case property in this

case. It is urged that as the these items contain incriminating
evidence and are to be sent to FSL for examination and as such
same may not be released to the applicant/accused.
I have perused the reply, personal search memo of
applicant/accused and seizure memos filed by IO.
In view of submission made, SHO PS ACB is
directed to release the personal search articles i.e. one green colour
mobile phone make “Redmi” IMEI No. 869580055296504 &
869580055296512, one brown colour wallet, copy of Aadhar Card,
copy of PAN Card bearing no. ENUPS7261G and cash of Rs.
100/-, to the applicant/ accused Sahid Chaudhary on production of
valid ID card by the applicant/accused and against proper
acknowledgment. However, request for release of his one mobile
phone make ‘Samsung Galaxy M01” IMEI-1-356148112246514,
IMEI-2-356149112246512 and one CPU make “Dell” is hereby
disallowed. Accordingly, application stands disposed off.
Copy of order be sent to the IO concerned and be
also given dasti to the applicant/accused.
