No PW is present today.
The matter is listed today for recording of prosecution
evidence.
On last date of hearing, summons were ordered to be
served on two witnesses namely PW-23 B.C. Rai and PW-24
Umeshwar Prasad for their cross-examination on behalf of the
accused Rajesh Mishra.
Considering that this is an old matter, last opportunity was
granted to the prosecution.
It is submitted by Ld. Sr. PP for CBI that process issued to
PW-23 B.C. Rai has been received back unserved. He further
submits that earlier process issued were received back with the
report that he is unwell.
It is submitted by Ld. Sr. PP for CBI that after ascertaining
the physical condition of this witness, they shall move
appropriate application for recording of his statement through
VC.

With recept to PW-24 Umeshwar Prasad, it is reported that
this witness at present is in United States. Time sought by Ld. Sr.
PP for CBI to ascertain the availability of this witness.
At request, this matter be listed for further proceedings on
21.08.2025, by which date CBI shall ascertain the availability of
both these witnesses and shall move appropriate application as
required.
On last date of hearing, accused Rajesh Mishra was asked
to appear in person. In compliance of the said directions, accused
Rajesh Mishra, who is a US Citizen stated that he immediately
booked his tickets. It is stated by accused that when he landed at
IGI airport, he was detained and harassed by the Investigating
Officer of the present case namely Akash Srivastava.
An application under Section 15(2) of Contempt of Courts
Act has been moved by the accused/applicant. The same is taken
on record. Copy supplied to Ld. Sr. PP for CBI.
The matter be listed reply of this application on
21.08.2025.
IO is directed to remain present in Court on the next date
of hearing i.e. 21.08.2025.
