Present : Sh. Raj Kamal, Ld. PP for CBI.
As per the report of the Ahlmad, all the documents and
statements in respect of charge sheet have been filed by the IO. I
have perused the same.
Brief facts of the case as per the charge-sheet are that
this case has been registered on the basis of a complaint dated
27.10.2023 of Shri Rampal Singh Kalyani, S/o Late Sh. Suraj
Singh, It has been alleged in the complaint that the accused
Kamal Kumar, Head Constable, PS Maidan Garhi, Delhi
demanded a bribe of Rs. 20,000/- from the complainant for the
construction work on the plot of his daughter Ms. Saraswati
situated at Maidan Garhi, New Delhi.
The verification of the complaint was conducted on
27.10.2023 by Shri Rahul, Inspector, CBI, ACB, Delhi in
presence of Sh. Risabh Vishnoi, by visiting the site, i.e.,
construction work going on the plot of the complainant's
daughter located near Madudi Talab, Maidangarhi, New Delhi.
During the verification, the complainant met the accused Kamal,
HC and requested him for reducing the demanded bribe amount
to Rs. 15,000/-, but the accused Kamal, HC, remained persistent
on his previous demand of Rs. 10,000/- per lanter for the 02
lanters already built. During the said discussion, the complainant
also mentioned and verified about the previous payment of bribe

amount made to the accused Sh. Kamal, HC. The complainant
further informed the accused Kamal, HC, for making the
remaining payment on the next day, i.e., 20.10.2023 in afternoon.
The conversation held during the verification was recorded in the
Memory Card through DVR, which was marked as "Q-1 in CO-
49/2023". The Verification Memo dated 27.10.2023 was prepared
at CBI Office, Delhi after returning of verification team from
construction site.
On the basis of complaint and verification report, RC
0032023A0041 was registered and after registration of the same,
a CBI trap team was prepared by following all the norms and
procedures and subsequently, on 28.10.2023, the accused Kamal
Kumar was caught red handed, while demanding and accepting
the bribe amount of Rs.20,000/- from the complainant. The
tainted bribe amount was recovered from the right side front pant
pocket of the accused Kamal Kumar by the independent witness
Shri Rishabh Vishnoi, in presence of other independent witness
Shri Braj Kishor and the complainant. The IO carried out further
investigation which corroborated that the accused Kamal Kumar,
being a public servant, while working as a Head Constable, PS
Madangarhi, South District, Delhi demanded an illegal
gratification of Rs. 20,000/- from the complainant and was
caught red handed while accepting the same. The above said
facts prima facie disclose commission of offence punishable u/s 7
of P.C. Act, 1988 (as amended in 2018) by accused Kamal
Kumar. In the opinion of this court, there are sufficient grounds
to proceed against accused Kamal Kumar in the present
chargesheet, accordingly, he be summoned for 22.08.2024.
