Fresh charge sheet received on assignment. It be checked and
registered.
Ahlmad has reported that the documents are complete as per list
of documents.
The charge sheet and material perused. It is the case of
investigating agency that for transfer of the complainant, who was working as
‘Imam’ in a Mosque, A-2 Intezar Ahmed Zafari, who at that time was posted
in Delhi Wakf Board with his office at Darya Ganj as ‘Nigra Masjid’
(Supervisor Mosque) demanded Rs.20,000/- from the complainant sometime
in or around June-July, 2017. Thereafter he brought down the demand to
Rs.5000/-. On 17.07.2007 a trap was laid and when the complainant namely
Quari Nemtullah alongwith the panch witness Sanjay Kumar reached the
office of A-2, A-2 asked the complainant in presence of panch witness as to
whether he has brought Rs.5000/- qua his transfer? When the complainant
replied in affirmative, A-2 told the complainant in presence of panch witness
that he would send his Assistant A1 Zakiuddin, who was working as Assistant
Supervisor Mosque outside the office and that the said amount be handed over
to A-1. Subsequently A-1 was called by A-2 in his office and in presence of
complainant and panch witness A2 directed A-1 to collect that amount from
the complainant outside the office. Thereafter A-1 came out of the office and
in presence of panch witness obtained Rs.5000/- from the complainant. At that
time A-1 also telephonically spoke to A-2 from his mobile and also made the

complainant speak to A2 before taking bribe.
Those notes were already treated with phenolphthalein powder. Hand
wash of A-1 turned pink. FSL result confirms the presence of phenolphthalein
powder and sodium carbonate.
Sanction u/s 19 of POC Act, 1988 dated 29.07.2021 has been obtained
against both the accused, who were public servants.
Prima facie therefore, there are sufficient material to take cognizance
u/s 7/8/12/13(1)(d) r/w 13(2) of POC Act, 1988 as those provisions existed at
the time of offence of this case, and also for section 120B of IPC.
Both the accused are on regular court bail.
Issue summons to both the accused for 06.07.2022.
IO be also summoned for the said date.
