Both accused are present on bail.
Sh. Raj Kamal Arya, Ld. Amicus Curiae for accused
Subhash Chand.
Sh. Shivam Bedi, proxy for Sh. Krishan Kumar, Ld.
Defence counsel for accused Pradeep Sharma.
Vide my separate order of even date, pronounced in
open Court, prima facie case u/s 120-B IPC is made against both
the accused persons. Further prima facie case u/s 8 of Prevention
of Corruption Act r/w 120-B IPC is made out against accused
Subhash Chand and case u/s 7 & 13 (1) (d) of the Prevention of
Corruption Act punishable under Section 13 (2) of the PC Act r/w
Section 120-B IPC is made out against accused Pradeep Sharma.
Accordingly, charge is framed, to which they pleaded not guilty
and claimed trial.
Ld. Defence counsels submit that they do not want
to admit or deny any documents in compliance of Section 294
Cr.P.C. In view thereof, admission/denial of documents are
dispensed with.
Put up for PE on 30.01.2023. Let witnesses
mentioned at serial no. 1, 5 and 6 of the list of prosecution
witnesses be summoned for next date of hearing, apart from
MHC(M) alongwith case property.
