This is second application under S. 483 BNSS, 2023 seeking regular bail, filed by applicant/ accused Pankaj Kumar. Arguments on the bail application heard. Reply perused. After addressing arguments for some time, Ld. Counsel of applicant/ accused, on instructions, seeks permission to withdraw the present bail application, without prejudice to the right of applicant/ accused to move similar bail application at the appropriate stage. Separate statement of Ld. Counsel of applicant/ accused has been recorded in this regard. Ld. Chief PP for the State does not oppose the request of withdrawal of present bail application. In view of the aforesaid submissions made by Ld. Counsel of applicant/ accused and his separate statement -- 1 of 2 -- recorded today, the present bail application is hereby dismissed as withdrawn. Needless to say, that withdrawal of present bail application shall be without prejudice to the right of applicant/ accused to move similar bail application at the appropriate stage.
