Kansal, Ld. Counsel for accused Sunil Kumar (A-2).
Sh. Sanjeev Bhardwaj, Ld. Counsel for accused
Rajesh Kumar (A-3) and Manu Rana (A-4).
Fresh Vakalatnama has been filed by Sh. Sanjeev
Bhardwaj, Advocate, on behalf of accused persons namely Rajesh
Kumar (A-3) and Manu Rana (A-4). Same is taken on record.
PW-9 Sh. Ram Babu Rai examined in chief, cross-
examined and discharged.
PW Sh. Mohan Singh is present but discharged
unexamined at the request of Ld. Chief PP for want of original
record concerning the present witness.
PW Sh. Varun Rana is absent despite service of
summons upon him through his brother namely Sh. Himanshu
Rana. Sh. Jai Ram Garg has appeared through V/C on behalf of
said witness and has orally informed that the said witness is away
to Hyderabad and thus, is unable to appear before the Court today.
Considering the submissions made and in the interest of justice, no
adverse order is being passed against said witness for today.
Report regarding death verification of PW Sh. Francis
S/o Sh. Joseph, is filed under the signature of SHO, PS ACB,
alongwith certain annexures. According to said report, the factum
of death of said witness has been duly got verified and attested

copy of his death certificate alongwith statement of one person
namely Sh. Dinesh Singh Bisht are also annexed therewith. Same
would show that the said witness had expired on 16.11.2008.
In view of the aforesaid report regarding death
verification of PW Sh. Francis and the documents annexed
therewith, Ld. Chief PP for State has requested to drop the said
witness. Said request is hereby allowed and accordingly, the said
witness is dropped from the list of prosecution witnesses.
Put up for remaining PE on 22.01.2026 and
05.02.2026.
Witnesses mentioned at serial no. 1, 6 & 17 in the list
of prosecution witnesses be summoned for 22.01.2026.
Witnesses mentioned at serial no. 10, 18, 34 & 43 in
the list of prosecution witnesses be summoned for 05.02.2026.
On request of Ld. Chief PP for State, IO/Insp. Praveen
Kumar Saroha be called through notice for both the said dates.
Dates are given as per convenience of Ld. Counsels
for accused persons.
