FIR No. 21/2014
PS : ACB
State Vs. Satya Pal Singh @ S.P. Singh etc.
18.05.2022
Present: Sh. Vikash Kumar, Ld. Addl. PP for the State.
Accused is present on bail with Ld. Counsel Harsh Vardhan.
I.O. ACP Raj Rani Sharma.
Reply to the application U/S 207 Cr.P.C. is filed by the IO. Copy
Supplied. IO has supplied the deficient copies as mentioned at Serial 13 of the
application U/S 207 Cr.P.C. ie MarkX dated 09.05.2022. Ld. Defence Counsel
has fairly conceded that he has received deficient copies. Compliance of Section
207 Cr.P.C has been done.
Ld. Defence Counsel argues that certain directions are required
regarding the objections mentioned in the said application. Heard.
Accused has taken objection No. 1 in the application MarkX dated
09.05.2022 that copies of 18 pages from Measurement Books, provided with the
hard copy of the charge sheet, are missing from eChallan CD provided to the
accused. In this regard, IO submits that she has filed these 18 original pages of
Measurement Books alongwith charge sheet and copies thereof have also been
supplied to the accused but inadvertently, same could not be copied in the e
Challan CD. As accused has already been provided the photo copies of these 18
pages from Measurement Books and original thereof are already on record, there
is no need to supply fresh copy of eChallan CD containing those pages.
Regarding Objection No. 2 that the Page No. 118 have been
marked twice in the hard copy of the charge sheet, it is submitted by the IO that
page no. 118 are marked to the charge sheet only once and same nos are marked
on different papers which are annexed to the charge sheet and same can be
referred with regard to annexure. Regarding objection no. 3 Ld. Defence Counsel

has fairly conceded that same has been removed by supplying the fresh copies of
those pages. Regarding Objection No. 4 and 5,it is submitted by Ld. Defence
Counsel that IO has not given number to overleaf/back side of certain pages as
mentioned in the application and therefore, charge sheet is required to be
renumbered and index is also to be updated accordingly. In this regard Ld. Addl.
PP for the State submits that IO has given page number to the charge sheet as per
their practice and same can be repaginated by the Alhmad of the Court as per
procedure. As charge sheet has already been filed by the IO before the Court, I do
not deem it fit to direct the IO to update the index or to give new numbers to the
charge sheet which has already been registered. However, to remove the
ambiguity in the pagination of the charge sheet, Alhmad is directed to mark the
pages of the charge sheet as per rules. Objections accordingly stands dispose off.
Now to come up for argument on charge on 03.06.2022.
