Abhinav Singh Chauhan, from DM Office, Noida, UP submits that warrant of attachment qua the properties of accused Harmenn Sabherwal have been executed and in compliance of the said order, Rs. 1Lakh have been attached and a DD No. 006461 dated 29.06.2024 for Rs. 1 Lakh, drawn on HDFC Bank, Dadri, UP, has been prepared in favour of the court. Said original DD is filed on record. Let the said DD be deposited with the Cash Branch. Warrant of attachment qua the salary of surety Raj Kumar received back with the report that surety has been transferred from office of EEM-II (Shah. South) to Division (M)-I Shah. North Zone. Despite service of said Warrant of attachment in the office of DDO, MCD (East), EE(M)-I, Shah. North Zone, neither anyone appeared from said office nor any report submitted regarding attachment of salary of surety Raj Kumar. Hence, issue notice to the Page 2 of 3 -- 2 of 3 -- DDO, MCD (East), EE(M)-1., Shah North Zone, to give explanation regarding non-compliance of above-said order. Despite service of notice, none appeared on behalf of DDO concerned, DEMS/City S.P. Zone, MCD, Delhi, to give explanation regarding non-compliance of order of attachment of salary of surety Krishan. Accordingly,issue fresh notice to the DDO concerned, DEMS/City S.P.Zone, MCD, Delhi, to give explanation regarding non-compliance of above-said order. An application moved by surety Kishan ws 440 Cr.P.C. for reducing the surety amount is also listed for consideration for today. At this stage, ld. Counsel for surety Kishan seeks permission to withdraw the said application with liberty to move fresh application ws 440 Cr.P.C. on behalf of sureties Kishan and Raj Kumar. At request, application s 440 Cr.P.C. moved on behalf of surety Kishan is hereby dismissed as withdrawn. Application stands disposed of.
