Harmenn Sabherwal Vs. State
FIR No. 56/2022
P.S. EOW
10.02.2026
Present: Mr. Vikash Kumar, Ld. Public Prosecutor for State.
Mr. Mishal Vij Adv., for victim Shriram Verma
through VC.
Mr. Sandeep Sharma Adv., for victim Sunil Kaushik
through VC.
Ms. Sayantini Sahu and Mr. Shivam Khosla
Advocates, for the applicant/accused Harmenn
Sabherwal.
IO ACP Keshav Mathur and Insp. Amit Pratap are
present.
The IO has filed his reply. The same is taken on
record. Copy supplied.
During the course of arguments, Ld. PP for the State
submitted that the last rites as well as the prayer meet have
already been performed and therefore, there is no requirement of
the applicant/accused anymore. However, Ld. Counsel for the
applicant/accused submits that there are certain rituals that are
yet to be performed especially by the son of the deceased i.e. the
applicant/accused and therefore, considering the same as well as
the fact that certain financial arrangements have to be made by
the applicant/accused with respect to his aged father, the interim
bail be granted. She also submits that there is one
hawan that is
required to be performed on the 13th day from the date of death
and one
pooja that is required to be performed on the 31st day
from the date of death by the applicant/accused.

It is an admitted case on behalf of the
applicant/accused that the last rites as well as the prayer meet
have already been performed in the absence of the
applicant/accused. There is no mention of any other ritual either
in the interim bail application or the statement of the sister of the
applicant/accused recorded by the IO. In fact, the sister of the
applicant/accused has refused to take any responsibility if the
applicant/accused jumps the bail. In these circumstances when
the able family members of the applicant/accused are not ready
to take the responsibility and also on the other side considering
the possible requirement of the applicant/accused to perform the
last rituals, if any, with respect to his deceased mother, the IO is
further directed to verify if any such rituals are still left to be
performed. The IO shall also confirm if the presence of the
applicant/accused is required in the performance of any such
ritual, if any. The IO shall also verify the date when such ritual,
if any, is required to be performed.
List for consideration on the interim bail application
on 12.02.2026.
