Ld. Counsel for accused Diprana Tiwari submits that
the mother of the accused expired just yesterday due to which he
could not appear before this court today. He is exempted from
personal appearance only for today.

IO has filed an application to issue Non-bailable
warrants against Accused Vinay Kumar Gupta. The same is taken
on record. Ld. PP for the State as well as the IO submit that the
name of Accused Vinay Kumar Gupta came out in the
disclosure statements of the accused persons and it appears
from the said disclosure statements that the accused Vinay
Kumar Gupta had an active role to play in the commission of the
offence. The IO has filed an application for issuance of NBWs
against accused Vinay Kumar Gupta on the ground that despite
various efforts and notices, he has not joined the investigation and
his NBWs are necessary for conducting judicial TIP, recovery of
cheated amount, confrontation with bank accounts and ensuring
his presence before the court.
The case diary as well as the disclosure statements
of the accused persons have been perused, which reveal that the
name of the accused Vinay Kumar Gupta has come out in the
disclosure statements of the accused persons as one of the accused
persons. The notice sent by the IO has also been perused and even
though the IO requests that NBWs be issued to secure his
presence, this court is of the view that at this stage, bailable
warrants be issued against the accused so as to secure his presence
in the investigation. In view of this, issue bailable warrants against
accused Vinay Kumar Gupta in the sum of Rs.10,000/- alongwith
one surety in the like amount for his appearance before the IO on
30.10.2025.

submits that the main counsel is not well and therefore, some more
