1. The notice issued qua the accused, Harmenn Sabherwal has been
returned back with the report that his wife Smt. Simran was found at the given
address and she informed that the accused is not available at the given address;
that she has divorce proceedings going on against the accused in the Court of
Sh. M. P. Singh, Ld. Family Court Judge, Delhi and that at present, she does not
know the whereabouts of the accused.
2. The notice issued qua the surety, Sh. Krishan of the accused,
Harmenn Sabherwal has been returned back with the report that his given
address is correct; that in view of his nonavailability at the given address, the
notice was sent by SI Jagdish on his mobile no.9354204246 and that Sh. Krishan
will appear in this Court today.
3. At this stage, Sh. Krishan has appeared and requested for 10
minutes time to find out about the whereabouts of the accused, Harmenn
Sabherwal. At his request, the matter is passed over.

1. After taking the pass over, Sh. Krishan has sought 34 weeks time
to produce the accused, Harmenn Sabherwal. In the facts and circumstances of
this case, particularly the submission made by Sh. Akshay Dahiya, Ld. Advocate
for the accused, Harmenn Sabherwal, before the Court of Sh. Sudhanshu
Kaushik, the then Ld. ASJ06, NDD, PHC, the request for grant of 34 weeks time
is declined. Sh. Krishan is granted 10 days time to produce the accused,
Harmenn Sabherwal in this Court. List for the said purpose, on 01.04.2024.
2. At this stage, Sh. Aman Goyal, Ld. Advocate, Enrollment
No.PH/7137/2019 has joined proceedings through VC, from the login ID of Sh.
Adarsh Shandalia and submitted that he has been instructed by Sh. Akshay
Dahiya, Ld. Advocate for the accused, Harmenn Sabherwal to state before this
Court that the wife of the accused, Harmenn Sabherwal has informed Sh. Akshay
Dahiya, Ld. Advocate that at present, the accused, Harmenn Sabherwal is
admitted in a hospital in Chennai. The submission made by Sh. Aman Goyal, Ld.
Advocate is noted. He has been informed that it would be best, if Sh. Akshay
Dahiya, Ld. Advocate files a short affidavit in this Court regarding the instructions
received from the wife of the accused, Harmenn Sabherwal.

3. List on the date fixed i.e. 01.04.2024.
4. At this stage, Sh. Akshay Dahiya, Ld. Advocate for the accused,
Harmenn Sabherwal has joined proceedings through VC and submitted that
today he is busy in the Hon'ble High Court of Punjab and Haryana and that he will
file the affidavit regarding the instructions received from the wife of the accused,
Harmenn Sabherwal, today morning, within the next two working days. The
submission is noted. List on the date fixed i.e. 01.04.2024.
