The witnesses, Sh. Farooque Newazie and Sh. Sunil Chaudhary
have appeared. The witness, Sh. Sunil Chaudhary has sought permission go to
another Court. The permission is granted.
PW2 Sh. Farooque Newazie has been partly examined in chief. His
examination in chief has been deferred for want of original record of FIR
No.25/14, PS ACB. Upon inquiry, the Ahlmad has pointed out that the charge
sheet/final report of the said FIR is yet to be filed in this Court. Let the SHO/IO,
PS ACB be summoned to appear alongwith the original record of the
investigation of FIR No.25/14, PS ACB, on the next date. The Ahlmad is directed
to reseal the case property opened today, by using the seal of this Court, which
has been received today.
At this stage, PW2 Sh. Farooque Newazie has submitted that he is
not available tomorrow because the summons sent to him, did not specify the
date of 07.12.2023. In view of his submission, the date of 07.12.2023 is canceled.
Let PW2 Sh. Farooque Newazie be now summoned for examination, on
21.12.2023.
