IO Inspector Sanjay Kumar Singh is present.
PW1 Rahul Khanna is present along with Counsel
Ms. Anjulika. PW1 is examined and discharged.
No other PW is served or present today.
Ld. Counsel for the accused submits that the DVD which
was obtained by Inspector Satender Dhull from PW1 allegedly on
31.03.2014, which has been summoned by this Court today from the
Malkhana and which is the case property of FIR no. 25/2014, has not
been supplied to the accused of this case. The IO admits that a copy of
this DVD was not supplied to the accused. IO submits that the segregated
copy of video which was segregated at FSL qua this accused was only
supplied.
Ld. Counsel submits that a copy of that DVD which was
obtained on 31.03.2014 would be required by the accused for cross
examination of Sunil Chaudhary and Farooque Newazie.
It is ordered that the IO of this case shall get prepared
sufficient number of mirror copies of this DVD obtained on 31.03.2014
by Inspector Satender Dhull in FIR no. 25/2014, from the FSL, Rohini,
Delhi. Thereafter, the mirror copy of that DVD got prepared from FSL be
then supplied to the accused, one to the Prosecution and one be retained
on judicial record of this case.

Newazie will have to be recorded only when the above mentioned copy is
provided to the accused, it is directed that the Director, FSL shall get the
copying work expedited once the FSL, Rohini receives a request in this
regard from the IO. The IO of this case is directed to take the steps within
one week from today. As soon as the copy is received, the same be
brought in the notice of this Court by the IO, so that before next date,
copy can be supplied to the accused after calling the accused through
Court Notice, prior to the next date of hearing.
A copy of FSL result dated 23.12.2014 is also stated to have
been not supplied to the Counsel for accused and under the said FSL
report, the videos were segregated at FSL. Today, a copy of same has
been supplied by the Prosecution from another file to the Counsel for
accused.
No witness has been summoned for 31.03.2023 in this case
and the evidence of Sunil Chaudhary and Farooque Newazie will be
recorded first, but only after supply of copy of DVD to the accused,
therefore the date of 31.03.2023 is cancelled.
It is recorded that today the case property of FIR 25/2014
was summoned from the Malkhana on the directions of this Court when
during evidence of PW1, it was found that the DVD is required to be
shown to PW1 has not been summoned.
On request of witness, a copy of the evidence be supplied to
the witness.
Put up this matter for PE on 30th & 31st May, 2023.
